Terms of Service

1Introduction and Acceptance

Welcome to Model ID, operated by the International Modeling Foundation ("IMF," "we," "us," or "our"), a Dutch-registered non-profit foundation. These Terms of Service ("Terms") govern your access to and use of our certification platform, website, and related services (collectively, the "Platform").

By accessing or using the Platform, creating an account, or completing the certification process, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform.

These Terms constitute a legally binding agreement between you and IMF. Please read them carefully before using our services.

2Definitions

"Certification" means the verified status granted by IMF confirming that an individual or entity has met our ethical standards and completed the verification process.

"Certified User" means any Model, Agency, or Brand that has successfully completed the certification process and maintains active certification status.

"Model" means any individual who works or seeks work in the modeling, fashion, or creative industries.

"Creative Professional" means any individual who works or seeks work in creative industries including but not limited to photography, hair styling, makeup artistry, styling, set design, or other behind-the-scenes roles.

"Agency" means any business entity that represents, manages, or books Models or Creative Professionals for work.

"Brand" means any business entity that engages Models or Creative Professionals for commercial purposes including advertising, fashion shows, or content creation.

"Roster" means the list of Models and Creative Professionals that an Agency has linked to their account on the Platform, representing a professional working relationship.

"Digital Twin" means any AI-generated or digital representation that replicates the likeness, voice, biometric data, or identity of a real person.

"Report" means a formal submission through our reporting system documenting alleged misconduct or policy violations.

3Eligibility and Registration

3.1 Age Requirements: You must be at least 16 years old to create an account. Users under 18 require verified parental or guardian consent to complete certification.

3.2 Accurate Information: You agree to provide accurate, current, and complete information during registration and certification. You must update this information promptly if it changes.

3.3 Identity Verification: Certification requires identity verification through our designated verification provider (currently Stripe Identity). You consent to this verification process as a condition of certification.

3.4 Account Security: You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately of any unauthorized access to your account.

3.5 One Account Per Person: Each individual may maintain only one account. Creating multiple accounts may result in termination of all accounts.

4Certification Process

4.1 Application Review: All certification applications are subject to review by IMF. We reserve the right to approve or deny any application at our sole discretion.

4.2 Certification Duration: Model certifications are valid for two (2) years from the date of approval. Agency and Brand certifications are valid for one (1) year.

4.3 Renewal: Certified Users must renew their certification before expiration to maintain active status. Renewal requires payment of applicable fees and may require updated verification.

4.4 Public Directory: By completing certification, you consent to being listed in our public verification directory. This listing includes your professional name, certification status, and certification ID.

4.5 Certification ID: Each Certified User receives a unique Certification ID. This ID may be used by third parties to verify your certification status.

5User Obligations

5.1 Ethical Standards: Certified Users agree to abide by the IMF Ethical Charter and applicable Code of Conduct throughout the duration of their certification.

5.2 Prohibited Conduct: You agree not to:

  • Provide false or misleading information
  • Engage in harassment, discrimination, or exploitation
  • Misrepresent your certification status
  • Use the Platform for any unlawful purpose
  • Interfere with the Platform's operation or security
  • File false or malicious reports
  • Retaliate against anyone who files a report

5.3 Cooperation: Certified Users agree to cooperate with IMF investigations into reported misconduct, subject to applicable privacy protections.

6Fees and Payments

6.1 Certification Fees: Certification requires payment of applicable fees as displayed during the application process. Current fees are:

  • Model Certification: €100 (€50 for students with valid ID)
  • Agency Certification: Varies by agency size
  • Brand Certification: Contact us for pricing

6.2 Founding Member Offer: The first 500 Model certifications are provided free of charge ("Founding Member" status).

6.3 Payment Processing: Payments are processed securely through Stripe. By making a payment, you agree to Stripe's terms of service.

6.4 Refunds: Certification fees are non-refundable except where required by applicable law or at IMF's sole discretion.

6.5 Fee Changes: IMF may modify fees at any time. Changes will not affect current certification periods but will apply to renewals.

7Identity Verification

7.1 All certification applicants must complete identity verification.

7.2 We offer two verification methods:

  • (a) Automated verification via Stripe Identity (preferred method)
  • (b) Manual document review if automated verification is unavailable or unsuccessful

7.3 Manual verification submissions are reviewed within 24-48 business hours.

7.4 We reserve the right to:

  • Request additional documentation if initial submission is unclear
  • Reject verifications that don't meet our standards
  • Retain verification records for fraud prevention purposes

7.5 False or fraudulent identity information will result in:

  • Immediate application rejection
  • Certification revocation if already issued
  • Potential reporting to relevant authorities

7.6 Verification documents are stored per our data retention policy outlined in the Privacy Policy.

8Digital Twin Authorization

8.1 Ownership Rights: Any Digital Twin or AI-generated representation that replicates the likeness, voice, biometric data, or identity of a Certified Model is the sole property of the individual it is based on. This includes exclusive rights to consent to, control, monetize, revoke, or restrict any use, reproduction, distribution, or adaptation of the Digital Twin across all platforms and media.

8.2 Consent Requirements: Creation, licensing, or commercial use of a Digital Twin may only proceed with the Model's explicit, written, and informed consent, documented in accordance with IMF standards through our Digital Twin Authorization system.

8.3 Registration Requirement: All Digital Twins must be registered to the real Model's verified identity via Model ID or equivalent IMF-recognized verification. Unregistered Digital Twins are prohibited.

8.4 Third-Party Obligations: Agencies, Brands, and AI creators are prohibited from developing or deploying Digital Twins without valid ownership confirmation by the real Model. Violation of this provision constitutes grounds for immediate certification revocation.

8.5 Authorization Management: Certified Models may manage their Digital Twin authorizations through the Platform, including granting, modifying, or revoking permissions for specific use cases.

8.6 Enforcement: Any misuse or unauthorized exploitation of a Model's Digital Twin will result in revocation of certification for the offending party and may carry legal consequences under applicable law and IMF policy.

8.7 Future Features: IMF's Digital Twin Authorization system (launching Q2 2026) will provide additional tools for managing and protecting Digital Twin rights. These Terms will be updated to reflect new features as they become available.

9Likeness Monitor

9.1 Availability: The Likeness Monitor is available exclusively to certified models with active certification status. Access may be revoked if certification is suspended, revoked, or expired.

9.2 Permitted Use: You may only use the Likeness Monitor to scan for unauthorized use of your own likeness. Uploading reference photos of other individuals is strictly prohibited.

9.3 Identity Verification: Reference photos uploaded to the Likeness Monitor must match your verified identity. Photos that do not match your certified headshot will be rejected by our face verification system.

9.4 Accuracy Disclaimer: Scan results are provided on an "as-is" basis. While we strive for accuracy, results are not guaranteed to be complete or 100% accurate. False positives (incorrect matches) and false negatives (missed matches) may occur. You are responsible for reviewing and classifying results.

9.5 Third-Party Content: Model ID is not responsible for content found on third-party websites in scan results. We do not control, endorse, or assume liability for any content hosted on external websites identified by the scanner.

9.6 Evidence Packages: Evidence packages generated by the Likeness Monitor are created automatically and are intended to support takedown requests and legal proceedings. However, they may not constitute legal proof in all jurisdictions. You should consult with a legal professional regarding the admissibility and sufficiency of evidence in your jurisdiction.

9.7 Scan Allowance: Each model certification includes 2 free web scans. Additional scans may be made available in future updates and may be subject to additional fees.

9.8 Prohibited Conduct: The following uses of the Likeness Monitor are prohibited and will result in immediate account termination:

  • Scanning for individuals other than yourself
  • Using scan results for harassment, stalking, or intimidation
  • Uploading photos of third parties without their consent
  • Using the feature to facilitate any unlawful activity
  • Attempting to circumvent rate limits or scan allowances

9.9 Data Deletion: You may delete all Likeness Monitor data at any time via your dashboard. See our Privacy Policy for full details on data handling.

10Agency Roster & Collaboration

10.1 Roster Invitations: Registered or certified Agencies may send roster invitations to certified Models and Creative Professionals through the Platform. Receiving an invitation does not create any obligation to accept.

10.2 Accepting Invitations: By accepting a roster invitation, you consent to: (a) your professional profile being linked to the Agency on the Platform; (b) the Agency appearing on your public profile and verification page; (c) the Agency being able to view your certification status, profile information, and professional details as displayed on the Platform.

10.3 Declining or Removing Connections: You may decline any roster invitation without consequence. You may remove an Agency connection at any time through your dashboard. Removal immediately deletes the link from your profile and verification page. The Agency will be notified that the connection has been removed but will not be informed of the reason.

10.4 Agency Obligations: Agencies that use the roster feature agree to: (a) only invite individuals they have a legitimate professional relationship with or intend to establish one; (b) respect decisions to decline or remove connections; (c) not use roster or invitation features for harassment, unsolicited contact, or any purpose unrelated to professional representation.

10.5 Platform Invitations: Agencies may invite individuals who are not yet registered on Model ID to join the Platform via email. By using this feature, the Agency confirms they have a legitimate professional reason to contact the individual. IMF sends the invitation on behalf of the Agency but is not responsible for the underlying professional relationship between the parties.

10.6 Profile Visibility: When a roster connection is active, the Agency name and basic details appear on the Model's or Creative Professional's public verification page. Certified Agencies are indicated with a verification badge. This information is visible to anyone who accesses the verification page.

10.7 Data Access: By accepting a roster connection, you acknowledge that the Agency may access your certification status, professional profile data, and verification status as displayed on the Platform. Agencies may not export, scrape, or commercially exploit this data beyond the scope of the professional relationship.

11Reporting System

11.1 Reporting Options: The Platform provides both anonymous and named reporting options for documenting alleged misconduct or policy violations.

11.2 Report Handling: All reports are reviewed by IMF staff. We may request additional information and may investigate reported incidents at our discretion.

11.3 Confidentiality: Reporter identity is protected according to the reporting option selected. We will not disclose reporter identity without consent except as required by law.

11.4 False Reports: Filing knowingly false or malicious reports is prohibited and may result in account termination and potential legal action.

11.5 No Retaliation: Retaliation against any person who files a report in good faith is strictly prohibited and constitutes grounds for immediate certification revocation.

11.6 Report Retention: Reports are retained for three (3) years from the date of filing, unless a longer retention period is required for ongoing enforcement actions.

12Enforcement and Revocation

12.1 Enforcement Actions: IMF may take enforcement actions including warnings, point assessments, temporary suspensions, or certification revocation for violations of these Terms, the Ethical Charter, or applicable Codes of Conduct.

12.2 Warning Points: Minor violations may result in warning points. Accumulation of warning points may trigger suspension or revocation.

12.3 Suspension: Temporary suspension may be imposed during investigations or as a penalty for violations. Suspended certifications are not displayed in the public directory.

12.4 Revocation: Certification may be permanently revoked for serious violations. Revocation categories include Administrative, Professional, Safety, and Severe violations.

12.5 Public Disclosure: Revoked certifications are marked as such in the public directory. The reason for revocation may be disclosed at IMF's discretion.

13Appeals Process

13.1 Right to Appeal: Users may appeal enforcement actions including warnings, suspensions, and revocations within thirty (30) days of the action.

13.2 Appeal Submission: Appeals must be submitted through the Platform's designated appeal process and must include a clear statement of grounds for appeal.

13.3 Review Process: Appeals are reviewed by IMF staff not involved in the original decision. Additional evidence may be requested.

13.4 Decision: Appeal decisions are typically rendered within thirty (30) days. IMF's decision on appeal is final.

13.5 Effect of Appeal: Filing an appeal does not automatically stay the enforcement action unless IMF determines otherwise.

14Intellectual Property

14.1 IMF Property: The Platform, including all content, features, and functionality, is owned by IMF and protected by intellectual property laws.

14.2 Limited License: We grant you a limited, non-exclusive, non-transferable license to access and use the Platform for its intended purposes.

14.3 User Content: You retain ownership of content you submit but grant IMF a license to use such content for operating the Platform and providing services.

14.4 Certification Marks: Use of IMF certification marks and badges is permitted only by actively Certified Users and must comply with our brand guidelines.

15Limitation of Liability

15.1 Disclaimer: THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

15.2 Limitation: TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMF SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.

15.3 Maximum Liability: IMF's total liability for any claims arising from these Terms or your use of the Platform shall not exceed the fees you paid to IMF in the twelve (12) months preceding the claim.

15.4 Essential Purpose: These limitations apply even if any remedy fails of its essential purpose.

16Indemnification

You agree to indemnify and hold harmless IMF, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to the Platform.

17Termination

17.1 Termination by You: You may terminate your account at any time by contacting us. Termination does not entitle you to a refund of certification fees.

17.2 Termination by IMF: We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.

17.3 Effect of Termination: Upon termination, your certification status ends, you are removed from the public directory, and you must cease using any IMF certification marks. Active roster connections are severed and linked Agencies or Models are notified.

17.4 Survival: Provisions that by their nature should survive termination shall survive, including intellectual property rights, limitation of liability, and indemnification.

18Governing Law

18.1 Applicable Law: These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles.

18.2 Jurisdiction: Any disputes arising from these Terms shall be resolved in the courts of Amsterdam, Netherlands, and you consent to the personal jurisdiction of such courts.

18.3 EU Users: If you are a consumer in the European Union, you may also have rights under the laws of your country of residence that cannot be waived by contract.

19Changes to Terms

19.1 Modifications: IMF may modify these Terms at any time. We will notify you of material changes by email or through the Platform.

19.2 Acceptance: Your continued use of the Platform after changes take effect constitutes acceptance of the modified Terms.

19.3 Review: You are responsible for reviewing these Terms periodically for changes.
